2023 - 15th March - snowing part 3 - Unauthorised Absence...

 Unauthorised Absence is defined as...

1) when someone does not come to work

2) and gives no reason for their absence

3) or does not contact their employer

1a) But what if someone does not go into work because they are unable to get there, eg no buses running?

2a) Does give a reason for their absence and provides photographic proof even though there is no legal obligation to do so?

3a) And does contact their employer

Q) the buses are not running on the roads because it's unsafe to run the bus service due to the snow, yet called lazy for  not digging the car out of the garage and then expected to get into work on the same road conditions?

A) surely if it unsafe for the buses then it is unsafe for you to drive a car in the snow?

Where an employer chooses not to pay employees when they are unable to get into work, they may be seen to encourage employees to take excessive risks in attempting to get to work, possibly breaching their health and safety obligations.

If you don’t intend to pay employees for such absences, you may consider asking employees whether they would prefer to use annual leave, time off in lieu or whether they would prefer to make up the hours when they are able to attend work.

How can you follow absence policy if your employer hasn't give you the company handbook and does not have an adverse weather policy?

So is it still unauthorised absence?

In winter check the local weather forecast for warnings of icy or snowy weather. DO NOT drive in these conditions unless your journey is essential.

If it is, take great care and allow more time for your journey. Take an emergency kit of de-icer and ice scraper, torch, warm clothing and boots, first aid kit, jump leads and a shovel, together with a warm drink and emergency food in case you get stuck or your vehicle breaks down.
